  • is there a risk _ travelling with Advanced Parole

    I have an Advanced Parole / EAD. I got it in October Last year.
    I am still waiting for interview to be scheduled which looks like it will not be any time soon (in Texas).
    I would like to travel back home (Africa) and visit with family I havent seen them in years and I want to do that before I start my program at school.

    I applied for my AOS when I was out of Status for 3 years.

    Will there be a problem if I travel on my way back. Am I ok depending on the EAD?
    Anyone who has first hand information for a situation like mine please share your story as well.

    Travelling

    My husband got his AP in April and we traveled a month later. I am a US Citizen and have global entry, which is expedited customs processing. So when we got back to the US I went through the expedited processing and he went through the foreign passport line, well we got flagged. We had to wait in a room for about 1.5 hours, then the called him back for a couple minutes. They really didn't ask too many questions but said next time we should go through together and that is why we got flagged. He was out of status for 4 years before we got married. Hope that helps.

    I did talk with an attorney before we went, they said as long as he did not have a criminal record we should be ok

    4/18/18 - Interview ready to be scheduled

      Go through together where? In the Non Resident line?

        Yes. He went through the foreign passport line and I didn't have to go through any lines because of Global Entry. So he got flagged, even though he was pointing to me 15 feet away and I was waving at the officer. They told us next time to go through together

          So we waiting in this holding room for about a hour and a half, everyone was getting called before us so we were really concerned. Honestly, I think they were holding us to watch us. I did not need to be there but I refused to leave. So I think they were waiting us out to see how we interacted. By the time my husband got called back it only took a couple minutes and they asked a couple questions about where we went, nothing too invasive, and handed him back his passport.

          Most people got processed through pretty quickly but there were a few that may have been in trouble.

          It looked to be an adult daughter who may have been ok and her Mom who seemed to be travelling on a tourist visa. They had like 6 large bags and were really getting hammered about why she was here. We could hear some of the conversation and they seemed to be concerned about the Mom staying too long. The had requested to go through all the luggage and when we left they were still there.

          There was a guy getting aggressively questioned about his marriage. From what we could hear his wife was not with him and the officer was asking questions about the pictures on his phone of him with another woman. It seemed he did not live in the same city as is wife and had recent pictures from his trip looking too cozy with the other woman. They were still interrogating him when we left.

              I had no problems whatsoever. They had me go inside the room to fill out the customs form and that's about it but of course, I was ready with all my paperwork "just in case" they ask for it.

                Could you give us an info where you traveled from and also did you overstay your visa here before you got your ead/ap?

                  Yeah, they were in a room off to the side but you could hear the officer really grilling him about the pictures.

                  We probably saw 20 or so people get flagged while we were there, these were the only two that we could hear/see having an issue.

                  Now his passport has a AP Stamp in it for a year

                    I went to the Philippines, traveling from Los Angeles and yes I overstayed for 3 years.

                        Cool! Mine was pretty smooth. I was kind of scared of course because as I read posts they always suggest that before traveling abroad, you should have your green card on hand. But with my experience everything was fine except when we were leaving the Philippines, right where they weigh your luggages and give you your boarding pass, they were not familiar of the EAD/AP combo card. So they asked around took them maybe a good 15 mins before they figured out what it was (they said they?ve never seen anything like that) then I still had to pay the terminal fee. I believe it was 1600 pesos. And then when we got here at LAX, had to go to a room to fill out the customs form. That?s about it

                            Yes you can travel , I just came from South Africa and I am aNigerian . Just a few check on your profile and no question whatsoever. Just after the immigration sees you , he takes into another waiting room where you are stamped for paroled.

                              Thats actually my concern, leaving Manila coz I read the same thing that they are not familiar with it and its scary to think that what if nobody really knows about it. I?m still thinking if I should travel home once I get my ap or just wait til I get my gc hopefully soon.
