  • AOS: family vs employment

    Hi ,

I'm trying to get a sense of how AOS timelines work for different types of adjustment cases. I understand that family and employment based AOS cases are different because of visa-availability, the nature of the AOS request, and forms that need to be filled (for instance I-130 vs I-140).

However, is there any difference between the cases once it's been cleared from the NBC and forwarded to the field office--i.e. it's first-in-first-out regardless if its family or employment, or one type gets scheduled faster than the other.

I'm asking because USCIS timelines have a general range, and at the bottom of the page they provide the range separately for family and employment (in NYC, the family based cases seem to take way longer). My understanding is that once the case is in line for the field office, it doesn't matter, but hoping to hear what other people have to say.

I went to an infopass to ask about my case and also what the current PDs that they are interviewing. He looked up on his computer, and couldn't find any family based case. He said employment base has higher priority than family base. Couldn't find any information about it on USCIS manual but I guess this administration really wants to stop family immigration

it's like trying to guess the lottery numbers. I think that's why it's so frustrating because there simply isn't any consistency to it.

I have an employment based AOS and in two weeks it will have been a year since I submitted and still no GC, yet there is a guy in another post that claims he got his employment GC within 6 months. Same for family based...some are quick and others aren't. Just feels totally random to me.
