  • Should I update my passport while AoS is pending?

I chose to take my husband?s name after marriage and I went to the DMV to update my Driver?s License to reflect my new last name. When I filled out the AoS paperwork I used my married name despite my passport and visa showing my maiden name. I didn?t have time to update my passport yet but I will visit my home country next year and I plan on updating it.

If I get a new passport, will that affect my AoS in any way? Is the AP gonna be a problem since I will have a different passport? Should I just hold off on updating it until after I receive the GC?

Your passport is not relevant to AOS and getting a new passport should have no effect.

This is my personal opinion and is not to be construed as legal advice.

I wouldn't expect there to be any impact. If you're already in the process of changing names, that's easily explained. Any new document, just take it to the interview with a photocopy for the officer to keep. Also, if possible keep the cancelled document, and at the very least make sure you have high-quality copies if thy make you hand it in.
