  • What documents will a joint sponsor need to submit?

    Hi everyone so my husband is currently unemployed and since his parents have been supporting us entirely with our finance, his dad will be my joint sponsor for the I-485. I'm just wondering what kind of documents will he have to submit? We already have the I-864 filled out and his tax refund for the last 3 years.

    Also, Im still not 100% sure if my father in law will be my co sponsor or joint sponsor. He and my mother in law live in a different state but they (and my overseas parents) have been paying for all our expenses, so is it correct to consider him a joint sponsor and have him fill I-864 form? If not, what form should he fill?

    Your father-in-law should be your "joint sponsor". Your husband will fill out one I-864 as the petitioner and your father-in-law will fill out a second I-864 as the only joint sponsor. Each I-864 will need the most recent tax return, as well as proof of current income (pay stubs, etc.). The joint sponsor (your father-in-law) will also need to provide evidence of US citizenship or permanent residency.

    The only other possibility is being a "household member" of your husband's household, but to be a member of your husband's household, your father-in-law would either need to be your husband's dependent in taxes, or live in the same house as your husband; neither of those are true, so your father-in-law can't be your husband's "household member".

      So apparently we don't have to be household members for my father in law to be my joint sponsor?
      My FIL is retired, I think he still has income but there's a possibility that he doesn't and is supporting us with money from his saving account. In that case, what should we submit in lieu of proof of current income?

        Joint sponsors can be anyone who is a US citizen or permanent resident, domiciled in the US.

        Look in the I-864 instructions for what proof they need for assets. Note that he will need 5 dollars of assets for every dollar he is short in income.
