Question about AOS interview (marriage based): I864 again?

  • Question about AOS interview (marriage based): I864 again?

    I got the notice stated what I should bring for the interview:

    one of which is "a completed affidavit support form I 864 with all required evidence...."

    But we have already submitted the form I 864. Does everyone who is marriage based have this requirement for the interview or
    it's just me?

    The text is in the form letter, or at least in the one I received as well. But the whole list of things is prefaced with "unless already submitted". Read the whole letter carefully, line by line.

    I took this to mean that if there are no changes (and it's pretty common that there are!) I didn't have to bring a whole fresh document. I did, of course, bring copies of *everything* I submitted with the application, so in case of doubt, I'd have had something to show. We also brought an IRS transcript of the tax return (we submitted a photocopy of the actual return), my spouse's two most recent pay stubs, and the original of the employer verification letter.

    If my spouse's/sponsor's income had changed we'd have created a new document and brought it.

      Thank you! Just found they updated the I864 to a new version....I guess I need to fill out it again.

        You don't need to fill out an I-864 again if there have been no changes to your income situation from your existing I-864.

          Did you submit the 1040 and W2 or 1099 with the I-864 form?

            But IRS transcripts are more convenient for them to review.
            And if you submit the transcripts, "do not submit W2/1099".

            I think the letter is just copy and paste, so everyone got the same letter if marriage based.

            I will still bring the new I864, the copy of the old 864 and the 2015-2017 transcripts as well as pay statements, employment letter....

              They do prefer transcripts. The IRS won't issue transcripts unless your tax return has been accepted, verified and approved. Thus, USCIS can take them at face value.

              You may still have to submit W2s and 1099s, though. It's best to always refer to the instructions which -in a rather convoluted way- state:
