  • Our nightmare situation

    I just need to vent. (Atlanta office)

    We filed (marriage based) in July 2017, wife got her EAD/AP in October 2017 but it had her name misspelled. It took until January for them to issue an EAD card with her name correctly spelled (and it wasn't even some natural misspelling, her last name is Florez and it said Flroez).

    Whatever, everything takes a while in government work.

    So we FINALLY get our interview for July 2018. We go have the interview, the girl interviewing us says I definitely believe the marriage is real, but your medical form is expired. We submitted the medical form on July 17, 2017 and our interview was on July 18, 2018 (or something like that), so her medical was expired by ONE DAY because THEY DIDN'T BOOK THE INTERVIEW WITHIN A YEAR. She also is not satisfied that my wife has no outstanding SPEEDING TICKETS like are you kidding me? She says she has to send an RFE. I asked her how long before we would get it and she said "I'm going to send it out today". I reiterated that my wife's EAD expires October 10 and she says oh you'll be fine.

    Two weeks later I get the RFE. In the mean time my wife has gotten her medical exam again (more $$ out the door), and her speeding tickets are in like rural Alabama so she gets a copy of her driver history and all info she has on her tickets and we send it off the first week of August.

    We FINALLY get an alert that someone has finally received and reviewed our RFE response on September 15. Nothing since. I got an infopass appointment and we went today and all they said was "there's nothing we can do to make the officer move faster"

    All the while, my wife is a doctor who has clients who rely on her for weekly therapy sessions.

    And before you tell me to send a request to expedite, I already did, and the supervisor I spoke to today basically said: welp, IDK if we even got it and basically led me to believe those do not even work.

    Our next step is to file ANOTHER EAD request to renew, pay the $400+ filing fee, and wait 4-6 months to get it, or we can just wait for the incompetent immigration officer to tell us that we need even more proof that my wife has not even had a parking ticket or something.

    I'm just so pissed off right now. My wife is pregnant and we are trying to save $ for her maternity leave and yet she's going to lose her ability to earn money and her ability to drive a car because they took so long. Oh and getting an infopass, at least in Atlanta, does basically nothing because even the supervisor says "I'm not doing moving anyone's priority up at all".

    I just wanted to send some love to give you comfort right now. I always tell myself to not get too frustrated in cases that?s beyond my control. Also, you get a lot more with honey than vinegar. Things will happen before you know it. Enjoy your pregnant wife. All the best ❤️

      You can just file a request to renew your EAD for free because you're doing AOS marriage based.
      Also as soon as they confirm your request you get a letter, this automatically grants you an extension for 180 days for the EAD, pending getting the actual renewed EAD.
      There are many posts about this on the forum.

          i think you should be able to do some work yourself, didnt you file all this yourself as well?
          Certain aliens aliens who are in the United States may file Form I-765, Application for Employment Authorization, to request employment authorization and an Employment Authorization Document (EAD).             I just filed my renewal yesterday.

            Go read the instructions on the USCIS page for I-765 renewal. Do all of your paperwork today and get your passport photos. Don't delay. Once you receive the NOA from USCIS you should be able to provide that along with your EAD card and instructions from the website stating that USCIS is granting a 6 month extension for pending I-485 cases.

              Hey... what's about speeding ticket? How come the officer brought it up during interview? I m confused.

                The I-485 asks the intending immigrant if they've ever been cited, detained or arrested. If YES, then you need to bring proof of those incidents. Traffic violations (parking/speeding tickets, etc) count as citations.

                  It also says if the tickets were less then $500 not to mention about it so that's what I did, I did a red light violation and paid $160 back in 2013. I didn't want to jeopardize my situation honestly.

                  Just out of curiosity, were the speeding tickets higher than $500?

                    The instructions of the i485 and what officer asks are different unfortunately these days. If you have the full proof and everything just take it to the interview and mention it, the officer will decide if they want the proof or not. The word "citation" allows some lee-way and seems more and more officiers asking about this bullshit.

                      It doesn't say "if the tickets were less then $500 not to mention about it". It says if the tickets were less than $500 you don't have to attach documentation for the ticket. That doesn't mean you don't still have to answer yes and mention it.

                        This is actually interesting, it sparked my memory and I never actually thought about this.

                        I did a 5-week roadtrip in a Mustang convertible in the USA in 2012, I was still living in The Netherlands back then.
                        Got pulled over for speeding (85 where 70 was allowed or so, in CA) and got a ticket ($350) sent to my home address in NL and paid it.

                        I moved to the US in 2015 and when answering this question I never thought about this ticket as I wasn't living in the US back then.
                        Now im wondering if I should bring it up during the interview. They may be able to find it on my name but it's not like I had a US address or Drivers License back then.
                        I should probably just mention it although I don't have any documentation from back then.

                          Mention it and the proof of payment etc have with you. This what the interview is for to fix the i485 gray areas.

                              It is a standard question, it will come up. It is right up there with have you joined an organziaiton to ovethrow the government always gets asked.
