  • What are my options after getting RFE?

    Hello everyone

    Finally just finished my interview and it went well and I and the officer said, but he told me to get new medical exam because the old one is expired. Now I know that's will take time, but I heard some people say you can call and ask for approve even though you have an RFE, can I do that? OR what are my options and can do here in this case please?

    How come it expired? It should have one year validation. If you receive the REF form just send your i 693 with it;
    never heard about call and approval...

      When did the civil surgeon sign your I-693 as completed?
      When did you submit your I-693 to USCIS?

      From the date the exam is completed, you have 1 year to submit it to USCIS. Then, from the date it is received, it remains valid for one year for adjudication purposes. Thus, if you send it right away with your AOS package, then you're using up that initial 1 year window.

        yes this is the problem, I did my medical exam in June 2017 and my interview was just yesterday ( so it's expired ). How long does it take for the USCIS to receive my new medical exam? and when to approve it? if you have any idea.

        I submitted everything in Jun 2017 but then got RFE to get a sponsor, after that in NOV 1 2017 the USCIS approved my case to be under the process, so I thought that it will start after my case get approved.

          I see. Yes, it is expired. I would go to the same civil surgeon and ask them to bill it to your insurance as a yearly physical. It should take them no time to complete it +/- a few items. I would get that started soon. once you get the RFE, follow their directions for delivery. Sometimes they want you to drop it off at the Field Office and sometimes they want you to mail it.

            UScitizenFilingforspouse Has answered majority of your questions.
            Just to add to that , depending on if you mail it or drop it off. If you are required to mail it, I suggest send it express overnight . Express overnight will not guarantee that your application will be processed right away. Similarly, you cannot tell when they?ll approve it. You will just have to wait . It may take 5 day or it may take 15 days. The most efficient way should have been renewing your medical before showing up to your interview.

            Note to all. If you are scheduled for your interview and it has already been a year since you have done and submitted your medical please be proactive and get it renewed BEFORE your interview. Bring it to your interview for same day submission.

              Waitedlongenough brought up excellent points. Send it overnight. If you choose not to, that's fine. However, do yourself a favor and avoid USPS. Choose Fedex or UPS.
              Do it ASAP. If that's the only hold up, the sooner you do it the better.
