  • Marriage based AoS (where to file?)

    Hello everyone,

I have a question about where to send my application to. So my wife and I just got married. We decided to go ahead and fill out I-130 and I-485 so that I sponsor her because we know that it could be a long process. We are currently living in O.C. My question is: Can I send the applications to San Diego since the processing time there is faster than in O.C ( we heard that it could take more than a year to get an interview)?

You need to send your application packet to the National Benefits Centre for processing - you can find the address for the Chicago lockbox here: https://www.uscis.gov/i-485-addresses

They will then assign your case to a local field office. This is based on your zip code - you don't have a choice in the matter unless you move to an area covered by a different office. You can find your local office by entering your zip code here: https://www.uscis.gov/about-us/find-.../field-offices

      Jakelong159,

your question tells me you may not have read the directions for each form. Too often people go ahead and fill out these forms without reading directions; only to receive a Request for Initial Evidence later. By the way, all evidence and supporting documentation are required at the time of your filing - page 3/12 of the I-130 instructions. That includes ALL your evidence of bona fide marriage.

Many have found this thread very useful in preparing their evidence of bona fide marriage for their initial Adjustment of Status filing and interview. https://www.immihelp.com/forum/showt...011#post586011

      All the best,

Also another question, do you know how long it usual take to USCIS to set up an interview after the application is sent? ( FIY, I live in Orang County)

You should poke around the USCIS website. There is a wealth of information there that can help you better understand the journey ahead. You can find the case processing times for your field office here https://egov.uscis.gov/processing-times/ Your zip code determines your field office. You can find it here https://www.uscis.gov/about-us/find-.../field-offices
