  • Need help please

    I had my interview on Nov 26, was not approved on the spot but got sms alerts that my case was approved on Nov 30, still waiting for my green card to be mailed, I don’t have health insurance, I know I cannot get Medicare and Medicaid but are mine qualify to apply for ObamaCare? Is ObamaCare same thing as Medicare and Medicaid?

    Thera no more “Obama Care”. Consult your local offices as most states are different. I would also advice not to receive any kind of government benefits if you have a pending AOS case. In other words, go get a job and pay for Health Insurance. Your company can also buy health insurance for you.

      It is called the ACA and our lawyer advised us to not enroll because it is considered a public benefit and they can deny status by taking public assistance.

      You can buy a private policy outside of the ACA
      11/20/17 - PD - Marriage Based AOS
      12/10/17 - Walk in Biometrics
      4/10/18 - EAD & AP Approved
      4/18/18 - Interview ready to be scheduled
      4/19/18 - Combo Card in hand
      10/22/18 - Interview has been scheduled
      11/26/18 - Interview Completed
      12/6/18 - GC in hand

        First off Obamacare still exists for the time being, the only thing that no longer exists is the law permitting the IRS to enforce the individual mandate(penalty for not having insurance) that that doesn't go into effect until 01/01/2019. Secondly, even cost sharing reductions are considered a public charge because the government is paying a portion of your insurance premium. thirdly and finally, even if it wouldn't put you in the category of a public charge, in order to qualify for cost sharing reductions you have to be at or below a certain amount on the Federal Poverty Limit in order to qualify to recieve them. Unfortunately in the case of most AOS applicants if they are able to afford to adjust status they are over the FPL. so it would be recommended as ChicagoVB and WaitedLongEnough said and contact a private insurance company to try and see if you can get a plan. gotta love getting bored at a desk job two years ago and reading through the entire ACA bill. also as always this is not legal or financial advice as I am not a legal attorney or financial advisor and it's always recommended that you speak with an attorney or financial advisor for any an all Absolute Answers.

          Thank you for your response, I have a part time job of 4 hrs a day that pays almost as much as a full time job and also gives me time to take care of my family, it just doesn’t provide insurance so I was looking to get one myself. once again thank you.

            Neither the ACA nor its subsidy are considered for "public charge" inadmissibility purposes under current or proposed future rules.
