  • Can I apply for Parole in Place through my 18-year old if he is in the Service?

Okay guys my neighbor has a question. Can she apply for a PiP (Parole in Place) through her son who just enrolled in the Army? I know her 18-year old son cannot sponsor her because he is not 21 year old yet. But she has another US citizen son who is 21 years old now. So her question is can she apply for PiP through her 18-year old son and then use her 21-year old son to sponsor her to adjust status? Thank you guys!

yes. she has to first apply for PIP and IF granted she can then file i-485. i-130 can be filed anytime.

The OP mentioned in a previous thread that the neighbor entered the US without inspection, so she can't have an I-94. That's why she needs PiP -- if she entered legally then she can already AOS through her son.

This is my personal opinion and is not to be construed as legal advice.
