  • August 2018 EB3 filers

My case was received on August 3 and my EAD and advance parole was approved within a month. My I-485 was transferred to NBC on mid September and the notice stated - ?In order to speed up processing, we transferred your case to another USCIS office...?.
What a joke. I still haven?t received any update on my case so far. The I-485 processing time has been increasing ever since. Now it?s 10-24 months.
Has anyone who had field their I-485 EB3 on August received any updates yet. I know marriage based applications for August have already received their Green cards.
    Thanks,

Maybe not many EB3 filers here in the forum.
      Is your PD current?
It is great that your EAD/AP was approved in a month, most people wait much more.
I think there is nothing you can do but wait the 10-24 months (if your case is current).

I'm EB2 from late October and I have not heard of any changes on my account. Not even EAD. Did you call them or sent them a message through myaccount.uscis?

Sorry to hear that! Maybe send them a message directly through myaccount.uscis I heard some people got updates in their case after that. I don't know how much of that is luck or actual causation.

Spaniard88, is it possible to message them? I only see an option to open a service request if the case has been pending for over the specified time.

                    Hi everyone,

I submitted my I-485, I-765, I-131 and I-140 concurrently on October 6, 2018. My center is NBC (National Benefits Center). Here is my timeline so far:

                    Receipt Date for I-485, I-765, I-131: Oct 9, 2018
                    I-140 Approval Date: Oct 15, 2018
                    Biometrics Appointment: Nov 7, 2018

Case status still shows: "We accepted your fingerprint fee..."

I have two questions regarding my case:

                    (1) I have not received my EAD/AP combo card. Should I contact USCIS about this, and if so, how? My case is currently within the normal processing time, as NBC is processing cases up to September 16, 2018 filers as of today, which means I cannot raise SR or raise an inquiry yet. Please advise based on your experience.

                    (2) Since I have filed my I-485 or Adjustment of Status (AOS) in October 2018, I am expecting to wait about 12-18 months of processing time to get my Green Card. It appears that the closest local offices near me would be Los Angeles or Los Angeles County, and both offices are taking around 10 months to 24 months to process employment-based green cards. I was wondering if I should maintain a valid status while having my I-485 pending application being processed? I have maintained my F-1 visa status before, during and after submitting my I-485 application/AOS. At this point, after having my I-140 approved and am awaiting for my I-485 or adjustment of status to be processed, should I continue to maintain my F-1 visa status? I applied for the H1-B before applying for my green card, but I was not selected in the lottery.

Thank you so much in advance for your help!

california777, I would wait until your case passes the normal processing time so that they can not mention so when u raise a SR. YES, we need to maintain a valid status while our I-485 is pending. i have noticed that folks who are on H1 visa are getting their combo card sooner than the other.(Could be totally wrong)
Are you on a h1 visa or OPT?

For (1) wait until I-765 is outside of normal processing time. Unless you have a proof to expedite your case you can't really inquire them to look at your case (although sometimes if you run into a nice Tier 2 officer they might be able to help, however this is very unlikely to happen). See cases for which you can expedite EAD : https://www.uscis.gov/us-visa-and-im...edite-criteria

For (2) I think your status is ok while I-140 is approved. You should get an EAD soon enough. That will be your proof for valid status until GC is approved.

From what I read, sometimes, even when you want to maintain status, is difficult because once you use the EAD/AP card you are no longer on the previous status (F1 or other).

I wouldn't contact USCIS given that your case is not outside of normal processing time yet. Do contact them once it is outside of normal processing time.

If you already got the receipt for your AOS application, once your F-1 status ends your status will automatically change to AOS "status". Again, that will be the case if and only iif USCIS already sent you the receipt for your AOS, or I-485. Once USCIS accepts your AOS application, then you are on legal status in the U.S. after your previous status ends.

                            Hopes this helps.
