I need help trying to adjust status for my husband.

My husband and I got married in 2003 been together since 1999.I have been trying to apply for him but, Ihave been scared because I hear many different stories about him having to stay in his native country for about ten years. I would like for someone to give me some advice on what to do to be able to help him.Someone just please help me.

He would have to go to back to his country if he entered the US illegaly but I think that rule doesn't apply if he entered with visa.

If your husband entered the US with a valid visa (even if it has long expired) he will be able to get a green card without leaving the country. The situation is much more complicated if he entered illegally

Adjustment of status

If your husband originally came to the U.S. through inspection (legaly) and then went out of status (his visa, etc expired) then he can adjust status here in the U.S. if he came here illegaly and has another petition in process under the 245 law, before April of 2001 then he can still adjust. If he is here illegaly then he could start the process here, however would have to return to his home conuntry for his enterview. Most waivers for this situation are not approved unless his deporation would cause severe hardship on you or your child, this does not include hurt feelings etc. It's more health problems etc.
