I beleive you will get your EAD in 45-50 days after they received your all the applications and they dont send you any RFEs. By the way What do you mean by "Initial Interview request due on 03/13/07". Do you mean you have got your interview date already?. This page will give you a lot of information http://immihelp.com/forum/showthread.php?t=24035

I read the link. That's why I am hoping to get my EAD soon.

              Re:

Letters of Reference from friends and relatives would be good but they are not necessarily a requirement unless your interviewer finds some inconsistency when interviewing you and your spouse. This happened to a friend of mine who had his marriage-based interview in November of 2006.At some point there was an inconsistency during their interview and the IO asked them to mail letters from friends and family members attesting to the legitimacy of their marriage before he would approve the I-485.

My point however is that what is required is joint evidence of your marriage like a lease agreement, joint car ownership and/or car insurance, health insurance, joint bank account info etc. These pieces of evidence will be expressly asked for by the IO and can be considered primary pieces of evidence. If you have letters of reference they can serve as additional evidence but the officer may not even ask for them.

At my interview today I had four letters of reference which the officer clearly saw but never asked for or gave a second look at. However some people have taken them to their interviews under other circumstances and they were asked for or accepted. Bear in mind that every interview experience is relative so im not telling you that because the IO didnt ask me for or accept my letters that they wont be asked for or accepted at your interview. Its good to get advice but I would suggest you get some joint stuff together and just rely on your good judgment as it relates to you case.

              Good Luck!!

                interview

                thanks Howie...
Like you said I want the reference letters just as additional, I think is better have more than the necessary so they can see it right away and don't need to delay the process.
I will have the list of documents requested on the letter.
                thankyou again!

                    Re

Being on a visitor's visa I wouldnt recommend that you get married less than 60 to 90 days after entering the US. With a B1/B2 visa, your entry into the country as you may well know is temporary and for pleasure/business purposes only. If you come to the US on this visa and marry a US Citizen immediately after, you WILL most certainly have problems adjusting your status to PR and may get denied altogether.

However, getting married two or three months after entering the US and filing MAY still subject you to a grilling when you go for the AOS interview. The immigration officer interviewing you and your spouse CAN indeed determine that you used your visitor's visa improperly and had the intent to immigrate to the US from the beginning. You didnt give much details of your situation so what Im saying is all RELATIVE but if you get married anytime before 2 to 3 months after entering the US I would suggest you AT LEAST consult an immigration attorney and funds permitting, hire one for the adjustment process.

I came here on a visitor visa and I got married 6 months after I enter the States. The USCIS approved my I-130 Petition really quick.

                        Purpose

                        Thanks for the reply.

What was the purpose of your visit to states and what do you recommend if we get married in two months after entering states.

                          RE:Purpose

                          Hey punit,
I dont know if you were asking me or the other respondent these questions but Ill answer regardless. I came back to the US September of 2006 because my wife who is a US citizen was hurt and hospitalized in a car accident. At this time I was undergoing Consular Processing in The Bahamas for my Green Card and the I-130 was already filed and pending.

I took a leave of absence from work and entered the US on my B1/B2 visa to take care of her because of her injuries. Less than two weeks after being here the I-130 was approved and although my wife was improving we decided that I should stay and Adjust my Status to PR.

As far as your situation is concerned, after getting married submit immigrations forms I-130 Petition for Alien Relative (filled out and signed by the US citizen spouse), the I-485 Application to Adjust Status to Permanent Resident (filled out and signed by the immigrant spouse) and the I-765 Employment Authorization (filled out and signed by the immigrant spouse as well) together to the Chicago Lockbox Facility.

Thanks Howie, I appreciate your help.

Is it possible to get the driver's license as we apply for the status change?

                              Hey punit,

Yes you can get the DL for your wife. However, different states do different things regarding the DL and every situation is different. Once you receive the I-797 Notice receipt for the I-485 you can take that along with your wife's Passport to the DMV and get her a DL. In some instances though, I have heard that they dont issue the DL without the person having a SSN. You may want to check with others in the forum on that as I am not totally sure.

I already had a SSN from my University days so when I went for my DL I had no problems but they only gave me the DL for the length of my stay on my I-94. So if your wife's time is already running out on a 3 month B1/B2 visa then waiting for the I-485 would be useless in her case. You will probably have to wait until she gets her EAD card to attempt to get her a DL and then have it updated once she gets her GC or whichever one comes first. Beyond that, I suggest you ask around some more for other folks views on it.
