    Hi, i married a u.s citizen this past year and we also have a child together that was born in u.s. I have a valid b1/b2 visa that i had used multiple times and had a I-94 but returned it before it expired all of these before i got married. so last time i crossed since my husband lives in san diego he came and picked me up and we crossed by car, me as a passenger but i did not get a new I-94. so since then we got married, by question is am i able to adjust status ? to me it seems like i did enter the u.s legally,

    To you it might seem whatever, to the INS - they need proof that you entered legally, meaning I-94 or some other document, therefore to them you entered illegally, what you should have done is when entering the country at the border you should have asked for an entry document

      hi, thanks for the reply, at this point i'm not sure what to do, so u think i can't adjust my status ? all i have as proof is my b1/b2 visa .
