I would like to know what is considered as a gap in H1B and its implications.
H1B period with employer A: Feb 10th 2005 - Feb 9th 2006
Applied for H1B with employer B with a receipt date of Jan 20 2006. Also started working for B under the 'H1B portability' rule.
H1B period for employer B: Feb 20th 2006 - Feb 25th 2009.
Please note that H1B period with A ends on Feb 9th, but the one with B only starts on Feb 25th. So there is a gap of 15 days. But please also note that the subject started working for B using the H1B portability rule, which says that you can switch jobs as soon as you have the receipt for H1B.
So what I want to know what are the implications of the gap in the subject's H1B period as mentioned above (particularly with respect to I-485)? Does it make him/her 'out of status'.
Any insights would be appreciated.
