EB3, priority date: Aug-2006, got I-485 interview on May-27-2008 at local office?

    Hi Friends,

    Please throw some light on this.

    Category: EB3
    PERM Labor: Aug-2006 - approved
    I-140: Applied on April-25-2007 – pending, case moved to local office in July-2007.
    I-485: Applied on Aug-17-2007 – pending, case moved to local office in March-2008. Got I-485 interview from local office on April-8-2008, to attend on May-29-2008.

    Please let me know, if any are on same boat. If you have attended the interview, please let me know what kind of questions they asked and why they are calling for interview?

    The interview document doesn’t say any thing, other than list of documents needed.

    Firstable, i want to let you know that USCIS online page shows that officers reach in processing time frame for I-140 the month of Augist2007(last update of 15 march 2008 Texas service center).you applied your I-140 in April 2007.If your application is in Texas center ,that means they passed yours.If it is in Nebraska,you still can wait.
    Concerning your question,i did not hear about interview in EB for I-485.May be in some situation,it can hapen especially if there is a reason for that.
    Let me ask you: what kind of visa you are holding right now?Is your status visa right now legal? How is your back ground? Because I-485 application is not based on relation between applicant and petitioner or company like I-140. It is based on other stufs such as history of applicant ,residence,your health(medical exam),back ground FBI chek . Did you got your EAD(I-765)?if not may it is a bout it.
    Any way let me know.WE may share this discusion,because i am applying for I140 and I-485 EB3 too in july 2007(both still pending).My priority date is in november 2006

      I am on H1B and my status is leagal and have all pay stubs, W2's and returns.

        Hi Balaji.

        Quick question, how were you able to file I-485 even though your priority date (2006) is not current. Here is my situation, i got my I-140 approved a while ago and i am waiting for my Priority Date (Aug 2007) to be current, sothat i can file my I-485. is it not the case? If its possible to file 485 before the PD. I will be exiting and jumping around for atleast a day. Please reply or if possible please reply to my email kishorekodru at gmail dot com.

          I attended the interview; there was a fire drill at USCIS office on that day. So, we had to wait out of more than an hour and they let every in. I was called after 45 minutes past my scheduled time. Interview was only 2 minutes, just told, the interview was a wrong call. Interview call was from my employer’s location local office not from my physical location local office. The IO told case will be transferred to processing center and if needed, there might be an interview at my local office.

          IO was nice and asked, how I can help you?
          1. I asked IO, is there any reason for interview?
          IO, I don’t see any reason for interview, as it was filed very recently and PD are not current.
          2. My I-140 is pending for very long time is there any reason and status of it?
          The case status will be notified as per the proceedings.
          3. Any date of further interview?
          There may not be one.

          I asked IO to add EVL to my documentation. Up to now I haven’t had any LUD.
