  • F1 visa and travel

I am asking this on behave of my friend. She is on F1 and in good standing. Recently she got married to USC and now wants to travel out of states. She has not filed AOS yet, she intends to travel on F1 and reenter using the same. Will she have any problems re-entering the on F1 visa. Plis anyone suggestions or thoughts

If she has not filed AOS, she should be able to return on F1. However, it is not recommended as she has immigrant intent due to her marriage to a US Citizen and by law, F1 student should not have immigrant intent while entering at the POE.

This might cause issues during AOS adjudication later on.

Thanks for your suggestion. The other thing she included husbands name on her documents even though she has not filed AOS, the school is aware of name change. Do the ins check into all details at POE

Do they check or not is not an issue.

If they check, she would be risking her entry and could be sent back by expidited removal and has to wait for the immigrant petition to be approved while waiting in the home country. Not worth the risk. Better avoid travel until the parole is granted.
