  • B1 to F1 ...Pls Help !!

    Hi ,
I am in USA now in B1/B2 visa to attend few fairs and conferences and lay foundation for my future art in the books of my client. Now after coming here I came across a Bachelors degree in a nearby college .They were advertising.I am quite interested to attend their bachelors course for my further study. Thus as i learned through googling that I have to change from B1 to F1. Now I need your help to know what are the difficulties :

    a) My answer at POE was only to attend conferences & thus there was no preintention.
    b) My I-94 is dated till early July but I have a 1 yr multientry visa.
    c) What is to be done to change ??
    d) How much time wd it take and whats the cost ??

    Can someone help me ??

It Is No Harm In Trying, Good Luck!!

Change of Status from B1/B2 to F1 or M1

A visitor must tell the port of entry official that he or she is a "prospective student" regardless of whether or not the actual visa states "prospective student". If the visitor has an I-20 or multiple I-20s, then he or she must present the I-20 to the port of entry official. In order to change status from B1/B2 to F1 or M1, the I-94 card must be marked "prospective student". If the I-94 card is not marked "prospective student", then the only way to become a student will be by leaving the United States and applying for a student visa.

IT IS NO HARM IN TRYING, GOOD LUCK!!

    Change of status to F1

To request a change to F-1 status, you should file FORM I-539. You must submit your original form I-94 and your original Form I-20 (Certificate of eligibility for NON Immigrant student) issued by the school where you will study. Also you must submit documentaion that demonstrates your ability to pay for your studies and support yourself while you are in US. Note ( DO NOT use FORM I-539 for F1 extension) Please contact your designated school official at your institution.

H1B to F1 It is advisable to attach a letter from your employer stating your last day of employment, because this will prove that you are in a valid status while applying for status change from H1B to F1.

You can start attending school while your application is pending. But you can get assistantship only after approval. When you travel abroad next time, you have to get the F1 VISA stamping. The time you spent on your F1 can be deducted from your 6 year clock (Eg: you can be in us for 8 years (3 years H1B+ 2 years F1 + 3 years H1B)
