  • Date question regarding GC

    Hi all,

I finally got a date for my GC interview, i should be happy BUT it's 2 weeks before our 2 year marriage anniversary so that kinda sucks.
I submitted my medical forms right away with my AOS paperwork back in dec 2017 so they are no longer good. (I know n00b mistake, i didnt know better)
What if we go to the interview, forget about updating the medical exam and then get an RFE and submit an updated exam later, say 2 weeks later..
What would the result for the GC approval date be?
This is my opinion, not legal advice!

    AOS (c9) 2 USC 485/130/131/765
    122017 - PD
    012518 - Biometrics

082618 - "we scheduled an interview for your Form I-485"
    090418 - 2nd we scheduled
    091018 - first interview canceled
092118 - Request to reschedule int
    102318 - Renewal filed EAD/AP
    030819 - EAD/AP Card in hand
040219 - We canceled your int
    040519 - Int sched
    051419 - Interview
    053119 - approved

Well if the medical form was signed less than 60 days before you send it with the I-485 then it is valid for 2 years and not 1, so they could be still valid to Nov/Dec 2019.

Some people do that but most don't post back on the forums. I read that some officers, if they find the marriage ok, they could wait for a couple of weeks to approve the GC and give an unrestricted 10 year GC.
Nov 2018 - Package sent - EB - Texas Service Center
Day 1 - Package received at the lockbox
Day 999 - Card delivered to me - Aug 2021

From that updated policy guideline (https://www.uscis.gov/sites/default/...93Validity.pdf)
5 However, some Form I-693 submitted to USCIS before November 1, 2018 may be subject to the previous validity period policy, as explained more fully in the Policy Manual.

This is my opinion, not legal advice!

Yes, some I-693 may be subject to the previous validity, that's why I'm asking if the civil surgeon signed the form less than 60 days from sending the I-485, if it was more than 60 days, the form is only valid for 1 year.

        From USCIS Policy Manual:
        https://www.uscis.gov/policy-manual/...rt-b-chapter-4

Form I-693 Submitted to USCIS Before November 1, 2018
When did civil surgeon sign? No more than 60 days before underlying benefit application filed with USCIS
When was underlying benefit application filed with USCIS? No more than 60 days after civil surgeon signed the I-693
I-693 retains evidentiary value through 2 years from date civil surgeon signed I-693

Edit: some officers are not aware of the changes, so you may want to print the link I posted and explain the policy to them (if that will be beneficial to you)

Ah well in this case i will not get an updated medical exam done then. I submitted the one with my paperwork about 20 days or so after I had it done and signed.
Now i guess it's just hoping they will work with me and give me the 10yr.

I hope you get an officer that will see that you are close to the 2 year anniversary and hold the approval just enough to give you the 10 yr GC. Good luck and keep us posted.

              Thanks, me too!
At this point, I'm very much over traveling on AP (took me 4hrs at ATL and 3,5 at IAD) and dealing with renewals so here's to hoping.
