  • Filing Fee Help

    Hi all,

After some of my documents were lost when being returned for an error, I re-filled and printed everything out (corrected the error) and sent it again. I just received another notice saying the I-765 form is the OLD one, and I must fill out the new one. No issue, I am doing this now.

They also said my filing fees were incorrect. Given the first time, when my documents got lost in the mail being returned, they did no identify this issue to me I am skeptical.

I am adjusting my status and sending the I-765 with it. Family based adjustment.

What did everyone send in as their filing fee? Also, did you put all the filing fees on one credit card authorization, or split them?

    To confirm what I authorized:

    $1,225 USD to cover I-485 (including Bio-metrics)
    $535 USD to cover I-130

    Total authorized: $1,760.00 USD

I did not file a fee for I-765 as I believe it is exempt with concurrent filing per the instruction manual:

    12. (c)(9) or (c)(16) Any current Adjustment of Status or Registry applicant who filed Form I-485 on or after July 30,
2007, and paid the appropriate Form I-485 filing fee. If you file Form I-765 separately from your Form I-485, you
must also submit a copy of your Form I-797C Notice for Form I-485, as evidence of filing Form I-485 on or after July
30, 2007, and payment of the appropriate filing fee. If you did not pay the appropriate Form I-485 filing fee because
your filing fee was waived or you are exempt from paying it, you must pay the Form I-765 filing fee or request that
the filing fee be waived; and

So it looks like my fees were sufficient, just the incorrect form format (I sent the old one). Odd that they screwed that part up. I called USCIS to clarify too and the agent advised it sounded likeI had sent the correct fees, so they've escalated this for me to a tier 2 officer.

In another twist of evets, can anyone shed light on below?

An attorney friend who is helping me out got my I-765 returned to his office today, without any of my other docs (I-485, I-130/130A etc.). They just advised me through a tier 2 office on the phone I should be getting it all back together.

No money at all has left my account.

Has anyone else had experience of them sending only one of the forms and holding the rest? Can't imagine they send all this seperately?

I did the same thing, also split the payments up.... so one authorization for 1225 USD and I wrote on the authorization what it was for. and then a second authorization for the 535 USD.

yes, everything will return back to you in the same package, I don't know why they return to you only i-765. At first, I got rejection and 3 notice of action receipt for 3 form i485, i765 and i131. All was sent in the same package and return back to me after 2 weeks. It cannot be separately unless it was sent to USCIS in seperately

Very odd. I got the I-765 back in one mail and then the rest back separately three days later.

Final question for people; my I-765 was rejected for having an outdated form. I have the updated one sorted now.

The other forms had a rejection notice on them relating to the I-765 rejection...nothing on there said they had issues with them. When I check one of my other forms, this also had an expire ddate on it. Is it possible that even though the date is out, the form is the same so they don't care for that one? I have had no rejected on that form specifically.

I am just worried I'll en up with yet another rejection!!

                      Hi all,

So i sent the packages back with the correct formatted form of the I-765 and the filing fees for concurrent filing as mentioned above and confirmed by a tier 2 officer. They are sending me a rejection notice for incorrect filing fee AGAIN.

Has anyone else had this issue?

That is SO weird!! Cos I think I did the exact same thing as you.... 2 credit card forms, one in the amount of 1225 and one for 535. I wrote on the forms what they are form even though it doesn't say to write that on there. Both signed of course.... maybe they are just having a problem charging the credit card?

Remember that one applicant who didn't sign the G-1450 form and they still charged him for the filing fee? USCIS is something special... *facepalm*

So I may have gotten to the bottom of it (I may be the fool here for not hiring a proper immigration attorney - but I made it clear to a tier 2 agent what I was doing and they didn't seem to say I was doing it wrong).

I was told today I should be holding off sending the I-765 separately? Waiting for my receipt notice for the I-485 and I-130 and then attaching that to the I-765 application, sending this at a later date.

Can anyone shed some light? Have I been dumb, or is something else amiss? I have been sending it in all together, I-765 included....
