I was told today I should be holding off sending the I-765 separately? Waiting for my receipt notice for the I-485 and I-130 and then attaching that to the I-765 application, sending this at a later date.

Can anyone shed some light? Have I been dumb, or is something else amiss? I have been sending it in all together, I-765 included....
My suggestion that you should wait i130 and i485 got accepted, then send i765 later when you got receipt notice from i485

    3/29: Biometric done
    4/23: Biometric done second time

7/30: request I765 case out of normal processing time start at SR...

Oh wow that got so confusing!! I wonder if the USCIS is thinking about the I-765 filing fee and not understanding that it is waived because you filed the rest? Is the USCIS just very confused? I filed the I-765 together with the rest without any problems...... If it is just because they are confused you could just wait with the I-765 and send it afterwards when you get the I-797s for you AOS case but it really shouldn't be necessary. Did you write on your credit card forms for which cases it is? I know it doesn't specifically ask it anywhere on the form but I wrote it in big letters that it was for the I-485 and I-130.
This must be so frustrating for you!!

It does seem very odd. I have seen and researched cases where people sent everything in one pack and it was fine, I have seen a couple of examples where people had the same issue. As I have a job offer pending I am supposed to be getting it expedited and was in touch with the congressman's office anyway - the immigration person there is escalating this to their liaison officer to get to the bottom. We may just have to send them separately as others have done.

I wrote on the forms which each was and even did a covering letter explaining a tier 2 officer had advised there is no fee for the I-765. Very confusing, I was very clear with the tier 2 officer I was sending in the same pack as the I-485, I-130 etc.

There’s no fee for I-765 which means you’re not supposed to attach any check or credit card information regarding it.

So after all that, the issue the second time around was my debit card limit rejecting the payments. My congressman's office finally found this out by contacting their point of contact at USCIS. They admitted they did not advise me the payment had bounced the first time (when the I-765 format was the old form) or the second time, and that the multiple times when I called USCIS they should have told me that. None of the rejection notices mentioned anything about the payment card being declined either.

So I have increased the limit on the card, will be re-sending through the congressman's office today, and their contact has apologized and said he will track the package to USCIS. When it gets there, he will ensure if any further issues they do not return the form and solve there and then. He said that is the only outstanding issue on the application.

At least they are now trying to be helpful, given the misinformation I received from them!

I'm glad you got to the bottom of it!! It's frustrating when USCIS gives out wrong information.... like they don't understand or care what this does to our situation.

DJarrett04 - how did this one turn out?

I've just had my I-765 rejected because of a missing page, but no payment taken for anything else...

I'm not sure if I resubmit only the I-765 or I'll get the rest of it back in the coming days?
                  1. 9/22/2020 - Sent to Chicago Lockbox (I130, I130a, I485, I765, I131, I-864, I-944)
