Update : my interview was Jan 14th but I didn’t attend it nor my husband. My husband and I have been together for 11 & 1/2 years and he has been abusive to me and our 5 children. March 2019 a few weeks after filing to AOS my husband hurt our oldest son and made him have bruises that lasted almost 4 weeks, almost 2 weeks after the incident our son showed his teacher and CPS opened an investigation against my husband, from both the children and I accounts of things they filed a neglect case against him and issued Order protection for him to stay away, he was arrested and kept on begging me to take him back so I decided to give him another change. We were separated from March to August and when he returned home things wasn’t that great but things got worst after our youngest son’s diagnosis (Brian tumor ). CPS never closed their case he was supposed to do programs and stopped doing it early October, during that time he became abusive again to both me and the children, December 09th CPS got a new called from our children school against him and ACS was willing to work with me to keep him in the home but he choked our oldest daughter and CPS removed him out the home again, at this point I didn’t trust him anymore and contacted a DV organization that I worked with in April, I had an immigration lawyer who wanted to file VAWA for me with how strong of VAWA case is have with evidence dating back to 2012 but I started the process and decided not to file it, I thought my husband would have changed and we would have had a future but that didn’t happen so I contacted the organization and I got a pro bona lawyer, she went to the interview in my place, she asked to put the AOS on hold until she can file VAWA to replace the I130 so the officer agreed and she had 30 days, we submitted all documents and filed less than 3 weeks. Now I’m just waiting for a new process and wished I didn’t have to go this route but unfortunately things happen and I’m prioritizing my children and my safety. Will keep you all updated as I get information
