Priority date on i485 dif then initial priority date

  • Priority date on i485 dif then initial priority date

    I applied for i485 within US in June 2019 after my I-130 was approved. They put a priority date on NOA of the day I filed i485 not my initial priority date when I filed i130 back in Mar, 2017.

    Does the pirority date matter for my case since I am applying within US or should I call USCIS to fix it. Would my i485 be processes on “first come first serve base” or would it take longer since the priority date is of this year.

    I appreciate if anyone can help.

    If you are in one of the categories that a visa is available immediately then your PD doesn't matter.
    Your I-485 will not be approved faster even if the PD on it says 2017 because you sent it in June 2019. It will follow the "normal" processing time for an I-485 for that date.

      Your priority date is the date USCIS receives your application, since you sent your applications on a different days the priority dates will be different. Once you file your i-485 priority date doesn't matter anymore and you case will be processed in the order it was received. If everything is in order processing time is mainly dependent on your local office.

      Now if there is severe delays and you decide to sue the government or to expedite your AP/EAD then priority date can be used to show your case is outside normal processing times.
