  • Changing interview Date.

    Hi everyone.

I need some help and wondered if anyone can help? We recently got our interview date out the blue with not much notice (1 month).

I have been living and working in the USA for nearly 4 years on my 01 visa. I have been married to my partner for two years and this year we decided to go for the green card instead of renewing my 01 visa. So far it’s gone pretty smooth and relatively quick. However, we just got our adjustment of status interview date, with not much notice. Sadly it’s landed right in the middle of one of the biggest career opportunities I’ve had. I am a musician and will be on tour for 3 months with 60+ shows all over the states. This has been organised for around 9 months by my agency and management team, everything is routed on a tour bus, with full production and sound, with every show announced and tickets selling. I have read up on this forum and people are saying do not ever try and change your interview date etc, I’m a worried as I will not be able to make the interview. If I miss a show it’s really going to damage my career and opportunities with how much work and production has gone into this tour. Will the immigration people understand my situation and possibly move the date till after my tour? it’s a tough situation as I have been living here on my 01 work visa and moved to the states to better my career. I did not move here on the intention of getting married and getting a green card. I feel like I’m stuck between a rock and hard place. Do you think this reason warrants a date change? Any suggestions tips on moving interview dates would be greatly apprenticed. Apologies for long winded thread.

Call them and reschedule Your interview. Explain to them you have a signed contract. They will reschedule.

It all boils down to which matters more to you. It’s tough, so I feel for you.

Rescheduling is a pain the **** and it may take between more than a month or up to a year or so to get a new interview date. If you are okay with that kind of waiting game, then reschedule by all means. Though this situation could be repeated though if you get scheduled for another new tour.

You should receive a letter in the mail within a week that has your interview date and hopefully your interview falls on a date where you won’t have a show. My advice is to make it work (if you have to fly across states, do it) if your interview date falls on a free day.

Obviously, it is your decision to reschedule but depending on when your interview is, could you make it to in and then return to wherever your concerts are? I would explore that option before rescheduling. If it is not possible, rescheduling it's not the end of the world. It is safe to assume that you are not the first or last person to have other arrangements for the day the interview is scheduled.

Thank you all so much for the responses, It's a shame it's so difficult to change the interview date. In an ideal world, would be be perfect if they let select a date in a timeframe.
After speaking with the team, I think we need to risk and try to changing the date. I'm not at the level where I can start cancelling shows especially with how much work has gone into this tour, it will also cost me a lot of money and damage. The management company have written me a letter along with the full dates of the tour explaining the situation, hopefully this will be enough.

My next question is, i'm currently here working and living on my "Employment Authorization" Card, this expires end of October 2020. If I reschedule the interview, I'm assuming I can keep working and living here on this card? In a worst case scenario it takes a year to get a new interview, would I have to re-apply or can I get an extension on this "Employment Authorization"?

Thank you all again for the help with this.

If your EAD is for the AOS (c09), then you just need to renew it. You can send the renewal documents up to 180 days before expiration, the receipt will make it valid for extra 180 days after expiration if they haven't sent you the new one.

I do not think you will have the worst scenario and waiting a year for next interview. I think they will reschedule 3-4 months after your original interview.
