  • They Denied Sponsor Who Make 120.000,00 A Year

    Hello

    I’ve file form I-130 / I-130A / I-765 / I-864

    But i forget the joint sponsor form I-864A




    First time i received notice from immigration office asked me to send them form I-864A and tax return for the most recent year, and they gave me a choice to get a different joint sponsor, i couldn't reach the joint sponsor after he moved out of the state so I decided to get deferent joint sponsor who making 120.000,00 year 2018, 53.000,00 year 2017, 57.000,00 year 2016 which is double what the first sponsor make, but i received notice from them again saying that my joint sponsor income didn't meet 125% of the poverty guideline for the petitioner

    I just don’t understand how they accepted the first sponsor but they needed the joint sponor to file form I-864A but they denied the second joint sponsor who make double what the first sponsor make

    Any help?

      Often USCIS notices can come several months late after the fact. For example, in May 2019 I received a USCIS notice and in Sep 2019 I got the same notice again referring to something I had already resolved. In the notice did it reference either sponsor specifically? Perhaps the notice you got was just referring to your first sponsor...albeit very late arriving at your door.

        Pphuff, its not the same notice cause the second joint sponsor name on it, i just don’t understand how they refused sponsor who make 120.000,00 a year

          It does sound a bit fishy or a USCIS error. Perhaps you can call them and nudge them to investigate or explain. Sorry I don't have any other suggestions.

            I assume the sponsor is a US Citizen or LPR? Has this person sponsored others recently?

            Could be an error.

                Yes he sponsor one person recently but even though i think its not a problem cause he is tax return 120.000,00 witch is mean he could sponsor more than one person

                    Is the sponsor first time sponsoring someone? That's the only thing I can think.

                      You'd better ask someone check your documents before you submit them to USCIS. What is this number "120.000,00"? You should use correct format to present numbers, like $120,000...

                        Joint sponsor should fill out I-864, not I-864A.

                          Ok, so joint sponsor doesnt fill out 864A. 864 A is for people in the same household that live with you and let you use their income. Joint sponsor fills out additional form 864 along with the petitioner.
                          Even if he doesnt have children living with him he has to count other dependents that could be living somewhere else. His wife is a dependent as well so as any intending immigrants. If he has sponsored anyone else before they will also count.
                          also if you didnt fill the forms out the correct way they will deny. Form 864 requires birth certificate adjusted gross income and tax transcript if its a regular job. If self employed tax transcript all 1099s 1040 schedule c and total income.
