  • Green card application and criminal conviction

My husband and I are here on O1 and O3 visas (I’m the dependent). He has become abusive so I am leaving the home in a few days. I have kept quiet his abuse but I feel fairly confident he would be arrested and convicted, though without jail time, if I were to provide the proof of what he has been doing.

because I’m leaving the family home with our children I imagine he is going to become very angry and try to legally force me back. If he does that, I COULD go to the police but I don’t want to jeopardise our application.

does anyone have any ideas how to go about it so I can leave him without divorcing, not be forced to return and not sacrifice the green card? I simply cannot return to my home country so being denied adjustment of status in the next 12-24 months is unfathomable to me.

additionally, might there be another way to still get the green card even if he husband is denied his?

So sorry to hear this. Your case is very complicated. Go hire an attorney. You could also go around for free consultations. Ask a handful of lawyers about your case. A lot of them are free.
    goodluck.
