    Hello Everyone . I have some problem based on AOS . I am studying master degree in US . I have a valid F-1 visa, my wife has Green Card . We applied for I-130 on October through online . Later we prepared document and send to USCIS I -485 , I-765 and I-131 forms on December 2019. I received receipts on January . USCIS took fingerprint on February. I received RFIE on March based on my I-485. They ask copy of my marriage certificate, and I-864 form( new sponsor because my wife income is not enough ) and I-130A form. I prepared these forms and send it on April.

    1) question I only send copy of my RFIE paper , end of the page of RFIE was written (please include a copy of all pages of this letter with your response ) I checked some website that they said that we need to send original of RFIE to USCIS because they will scan it first and it helps to track faster my case. Does it mean anything if I send copy of RFIE ? Does it affect to delay ?

    2 question I track my case it said ( Response to USCIS Request for Evidence was received ) How long does it take to response to my RFIE ? When do I receive my work authorization and SSN ?

    Hello Dustin,

    In my experience since you have completed your biometrics the next phase should be the mailing out of your work permit. However, you will receive significant delays based on the RFIE, but since they have received it then you will get your work permit within 3-6 months (or later). So all being well perhaps by August-October or before it will be in your hands.

    If you did what the RFIE paper stated and submitted clear copies of the RFIE pages then you have no need to worry. The first rule in immigration is to follow EXACTLY what the DHS/USCIS websites and forms tells you, before seeking second opinion from 'some websites'.

    If you applied for the SSN at the time you filed, then receiving it is contingent upon whether your initial documents have been successfully processed. Otherwise if you get the work permit without the SSN you can go with the work permit to your local Social Security Authority office yourself and get your SSN; of course you will need to take other documents of identification.
