  • TOPIC: Renewing non-immigrant Status while AOS is pending

    I got my i485 case receipt recently. At the present time, I am in F1 Visa (OPT) and it is about to expire in July. If I get into school again and generate new I20 is that confuse USCIS? Does it conflict the intention of immigrant and non-immigrant status?
    How can you explain that?

    Do you fear that your I-485 will be denied? Check with the school, you may get into school without F1 / I20 while you are AOS. Some schools may get confused and ask for GC (or maybe EAD/SSN).

      Yes. I feel scared about that. I mean if i generate i20 again , what consequences it might have ?

        I'm no expert, but I think you can keep your F1 status if you get a new I20 (continue studying other approved course after your OPT), as long as you follow the F1 requirements.

        If you get your EAD/AP and you travel abroad or start working in something other than what is F1 approved, you will no longer be in F1 status even if you continue studying.

        I think most people married to USC, just stop studying when the OPT expires.

          I'm in a similar situation. I applied for OPT in DEC 2019, but I didn't find employment within the 90 days rule. Somehow, my school still asking me to report my employment nowadays. If I understand it right, after the 90 days rule, the OPT will be terminated by itself?? (but they didn't close my sevis record and ask me if I want to close it.)

          I planned to go back to school this August, I will be likely to enroll in classes with AOS status.
