    Hi, my spouse is on F1 visa. I am planning to file for AOS. should we file joint tax returns or separate tax returns. which on is best for AOS process.

    Marriage based AOS is better to have joint everything, taxes, bank accounts, loans, etc.
    Nov 2018 - Package sent - EB - Texas Service Center
    Day 1 - Package received at the lockbox
    Day 999 - Card delivered to me - Aug 2021

      Taxes can be filed jointly or separately depending on what saves you more.

        we are looking for what is BEST for AOS process, not looking at the saving right now.

          Exactly! So everything should be joint. No brainer.
          B1/B2 married to USC.

          Timeline 2020:
          3/12: Sent package to USCIS.
          3/14: Package received by USCIS.
          3/23: Checks cashed.
          3/27: NOAs received.
          8/04: Biometrics scheduled for 08/13.
          8/13: Biometrics completed.
          8/14: Online case status (I-485 & I-765) changed to fingerprints were taken.
          8/14: Ready to be scheduled for an Interview.
          9/02: I-765/I-131 approved. Status changed to “New Card Is Being Produced.”
          9/09: EAD combo card mailed.
          9/14: EAD/AP in hand.

            You could have filed separately and still have no issues.
            Btw,.... unless one has filed for an extension, the tax filing season for 2019 is over (July 15th)

              You can file as "married filing jointly" or "married filing separately." My lawyer advised me that it doesn't make much difference which of these options you choose, as long as you file under one of these two "married" categories. Filing jointly made more sense for us in terms of taxes and felt better in terms of the AOS. But there might be good reasons for another couple to do married filing separately.

                I‘m using common sense. But, by all means buddy, you go ahead and file separately ????
