  • Name change before AOS - how to file it?

    Hi guys,


    I red many posts on this topic, but I ran into contrasting information and I as I just got my AOS application rejected (because I didn't file the i-944 form that is not even required anymore!!), I want to avoid further delays before resubmitting it.


    I got married in California this May and I changed my last name to my husband's last name.

    So, now I wonder, should I file the AOS application using my "old" last name or the new one? Would the marriage certificate be enough as a proof of that?

    The confusion comes from the fact that I know that the GC is a sticker applied on the passport (am I correct?).. And on my passport I have my maiden name, so I wonder weather the "mismatch" could cause any problem.

    Most people use married name and travel with a copy of the marriage certificate until they can change their passport.

    The GC is an actual card if your do AOS (living in the USA), you get a Visa stamp if you do consular processing (outside the USA). After you enter the USA with an immigrant Visa you will get a GC (physical card).

      Marriage certificate is enough proof of a change of name and as a result, you can file your AOS with your new name and there are sections that ask for any maiden names - you can then provide your maiden names. Remember to include your BIRTH CERTIFICATE and MARRIAGE CERTIFICATE as those certificates would PROVE your identity.

      The GC is an actual card and not just a sticker!

        What your "Courtesy Letter" look like? USCIS sent me a " Deficiency" letter that I missed my I-693. They told Do NOT send them anything until I receive another letter from them depend on if my case require interview. I DO NOT believe my case will require interview because it is and AOS from my dad.
        05/08/20: I-485, I-765, I-131, I-944 sent to USCIS
        05/13 Rejected due to lack of I-864
        05/27 resubmitted with explanation
        06/03 Rejected again-same reason
        06/13 Resubmitted with I-864
        07/07 Lockbox emailed back and ask to resubmit
        07/09 Filings accepted with PD 05/08/20 (nice)
        08/06 Prior biometrics applied to I485
        08/28 Took biometrics for I-765 only
        09/28 I-765's Cards Ordered
        10/02 EAD/AP received
        04/12 Interview Sched
        05/11 Interview done approval on the spot but no USCIS update online

          A courtesy letter from USCIS is a letter stating that I’ve not submitted a completed and signed I-693 at the time of AOS application and that I would be asked to send the I-693 via an RFE or when invited for an interview.

            I guess it is similar to what I received. I will wait on them to tell whether to send it or bring it to an interview.
