  • H1B ends in Three weeks , I-485 approval notice received, what next?

    My current H1B ends in three weeks, extension process is ongoing, but not submitted yet.

    Sometime ago applied for the EAD card renewal and have the receipt notice.

    Meanwhile a few days back, I received my i-485 ( as secondary, dependent applicant) approval notice by post. Yet to receive the plastic card.


    So. what am I supposed to do now? Submit the H1B extension with premium processing ?

    If I don't receive the extension receipt notice can I still keep on the H1B using the GC approval notice ?

    You are supposed to wait for your GC. From what I understand you can't have GC and H1B at the same time, the H1B expires automatically when you get GC. Congrats on your GC, I think you will get it in a couple of weeks.

      If your EAD is approved you can use the letter as the EAD!

      Due to the extraordinary and unprecedented COVID-19 public health emergency, the production of certain Employment Authorization Documents (Form I-766, EAD) is delayed.  As a result, employees may use Form I-797, Notice of Action, with a Notice date on or after December 1, 2019 through and including August 20, 2020 informing an applicant of approval of an Application for Employment Authorization (Form I-765) as a Form I-9, Employment Eligibility Verification, List C #7 document that establishes employment authorization issued by the Department of Homeland Security pursuant to 8 C.F.R. 274a.2(b)(1)(v)(C)(7), even though the Notice states it is not evidence of employment authorization.  Employees may present their Form I-797 Notice of Action showing approval of their I-765 application as a list C document for Form I-9 compliance until December 1, 2020.

        Thanks all for the replies.

        I want to know if I don't receive the Plastic Card by the time my H1B expires, can I still continue with my job?

        My EAD is not approved yet, but I got the receipt notice and I guess thats enough for extending it next 180 days.

          From what I understand is that when they approved the GC that day you became a legal permanent resident, so you can continue working without incurring illegal work. The only problem is that you don't have the actual GC to prove you are in fact a legal permanent resident. If in your job they ask for your status, you can show them the approval notice and tell them that you are waiting on the actual card.

              You can ask USCIS to stamp your passport. If they agree to do so, such a stamp would be valid for 30 days.

              But, you need to convince USCIS that you need one and then hope they accommodate your request in a timely manner such that it results in a stamp before you get the physical card.

                USCIS online status is showing that "Card Was Mailed To Me"on 3rd September. I don't see any USPS tracking number and still worse it does not show up in my USPS "informed delivery" dashboard. When can I expect it to be delivered, given that this was a long weekend?

                  hex Usually, the status change to "Card was mailed to me" then, a couple of days later, the status change again to "Card was picked up by the postal service", at that time you will get a tracking number and your card will be delivered to you in a week or so. It is a long weekend so you should get your tracking number in a day or two.

                      We got the same update on 9/4 with no tracking info either. I'm sure the status will update early this week to "Card was picked up by post office." As Enub4 said, that is when the tracking info becomes available. Don't be alarmed if it takes a couple of days with the holiday today. Congrats to you!

                        Hello,

                        I thank you all again for the information you provided.

                        I received the card today afternoon. by priority mail. Mailed to me on 3rd at 6PM.

                        Note that USPS Informed Delivery showed NOTHING about the mails.

                            It doesn't show up in the mail piece tab, it shows up in the "package" tab. Mine is showing up in the package tab section.
