  • I 765 rejected ugh

    Filed I 130, I 485 I 765 and was received 8/19/2020 at the Chicago lockbox. Today we received a rejection notice for the I 765. Seems I used an outdated version (the 5/31/2020 expiry form) and also they said I submitted incorrect fee for the form.

    I filed it concurrently with the I 485, so would I just send a copy of that receipt to show it was paid, thus the I 765 fee is waived? (Assuming we get a receipt...as I haven’t received the I 485 receipt yet either).
    USC filing for F1 OPT spouse
    8/18/20 I-130,I-485, I-131, I-765 packet mailed to Chicago lockbox.
    8/19/20: Rcvd and signed for at Chicago lockbox
    9/14/20: Rcvd I-765 rejection in mail. Used old form by accident.
    9/15/20: Called USCIS and got other receipt #s verbally. Agent said USCIS mailed other receipts 9/14/20. No texts or emails received even though we filed G-1145.
    9/16/20: Check cashed
    9/17/20: Texts received
    10/25/20: Recvd paper receipts in mail.
    10/26/20: Sent I-765 with I-485 receipt

    Wow, I consulted with a lawyer and paid for 2 hours fee to go over my packet before sending It out. But thanks for the ‘help’, why do people like you even join forums?

        Yes, refile the updated 765 form, and include a copy of your 485 receipt once you get it, along with a short cover letter explaining what happened. If you do not want to wait for the Notice of Action to arrive, I have heard that receipt numbers for forms often appear on the back of canceled checks once they have been cashed by USCIS, so you could try that route to at least find your receipt number in order to access the case online and show that the 485, along with correct fee, has been accepted. Probably wouldn't hurt to also include a copy of the check if you have it (or you can print from your online banking). Just my suggestion - hope it helps!

          Thank you, yes this helps a lot. I will look for that as soon as they cash the check or provide the I 485 receipt.

            Okay, for anyone who gets in a similar situation... I called USCIS and received all of my receipt numbers over the phone for I 485, I 130 and I 131. They still haven’t cashed my check But sent out receipts by mail 9/14.
            I just have to send the new I 765 form with a copy of the I 485 to show I don’t have to pay the fee. Whew, I’m just glad it is getting sorted out.
