My wife and I are Indians.
My wife has a priority date in Feb 2013 for her GC. She downgraded from EB2 to EB3 in Oct 2020 and we both received our EADs recently. My employer has now asked me to file for GC under EB1. Given this information and considering the current timelines, does it make sense to file for a GC under EB1? This is my line of thinking:
I will have to spend money on EB1 GC filing, after spending money on I-485 processing through my wife's employer.
I would like to obtain GC as quickly as possible
Given the time it might take to get a GC under EB1, if it starts now, even though it is current, what might make more sense for me: file GC under EB1 or wait for GC through my wife under EB3?
Secondly, if I file GC under EB1, will I need to withdraw EAD obtained through my wife's employer?
