  • Green card filing for family

I am an Indian citizen currently in Canada with my wife and two kids. I have an opportunity to move to US and file my I140, I485 and get the green card. Wife works in Canada and doesn't want to move right now.

Is it possible for me to move to US, get my GC and apply GC for my family from Canada?

I heard something about derivatives in AoS or consular processing that can help. But I can't seem to find details. Please help.

Yes. Derivative beneficiaries can immigrate at any time after the principal beneficiary immigrates, as long as the principal beneficiary still has a green card and a visa number is available for the original category and priority date.

If they are immigrating from outside the US, they would do Consular Processing instead of AOS.

This is my personal opinion and is not to be construed as legal advice.
