  • I765 question

    Hi My spouse is on F1 visa and have a SSN.

    While applying for the Do you want the SSA to issue you a Social Security card?
    (You must also answer “Yes” to Item Number 15. Consent for Disclosure , to receive a card


    Do we have to select Yes for this answer or no,

      1. You answer "No", no need for a new SS card, it will be the same number.
      2. If AOS then (c)(9), I-765 instructions page 15
      Nov 2018 - Package sent - EB - Texas Service Center
      Day 1 - Package received at the lockbox
      Day 999 - Card delivered to me - Aug 2021

        I would answer Yes to that question. That way USCIS will update the Social Security Administration once they approve your EAD/AP. Then, once you have the interview and your spouse's green card is approved, USCIS will update the SSA again, and your spouse will receive a new card that does not state "Valid only with DHS employment authorization".

          I don't think USCIS will update SSA when you get your green card.

          This is my personal opinion and is not to be construed as legal advice.

            Odd. I may not be recalling correctly, then. I thought my spouse received a new SS card days before receiving the green card in the mail.

              What was the fee for the I485? We keep sending the fee of 1225 on the website and they keep returning it saying it's the incorrect fee. NEED HELP!

                My spouse never received a new ss. We had an interview on August 11th and on August 19th she received her green card, but up to this point no social security. Since I check marked that too, why wouldn't uscis update this with ss?

                  Checkmarked what on what form? The I-485 only started having a place to apply for SSN since last month, so it must be the I-765 you are talking about (which has had a place to apply for SSN for years). The I-765 is to apply for EAD. If her Adjustment of Status was approved before she got an EAD, then she would no longer get an EAD (since she has a green card), and the automatic SSN from EAD application would no longer happen.
