Hi Everyone! I'm asking for help and advice please,
We filed our AOS back in June 2019 and it just took USCIS too long to schedule our interview but we finally got an interview date next month. We've been married for almost 2 years and a half now and this is our first interview; I have an EAD currently and I have been working in the same job for exactly 2 years now (since I first got my first EAD). My own income is a little over $45000 and my spouse's income was about $28000 except that she lost her job due to COVID a little over a year ago and she's been collecting unemployment ever since .
She's my sponsor on the application and we didn't have a joint-sponsor because we didn't need one at the time. Now my question is will her unemployment income go towards the minimum required income or no because it's through unemployment and not through an actual job?
My second question is whether or not my own income can be counted since it's part of the household income and we've filed taxes together two years in row with the last gross income on the last tax return being a little over $70,000?
I was really under the impression that my wife's unemployment would be okay and/or my own income would be okay as well based on similar questions and answers I saw on this forum; but today I asked someone in a private website that helped us prepared the original application and they said my wife's unemployment will not be accepted for her to sponsor me and my own income cannot be accepted as well because I got employed based on my EAD which I obtained based on the same pending AOS application. They said we absolutely need to get an joint sponsor soon and take that file with us to the interview.
Anyone has any experiences with any similar situations? Will the officer have any considerations due to COVID, etc?
Should we get a joint-sponsor and take it with us just in case it's needed? If and we do take that with us should we submit it right away or keep it with us and only submit it if we're told that we need a joint-sponsor?
Please advise, our interview is coming up and this is an issue that's starting to be stressful. I was hoping we might get approved on the spot but I think if we bring a joint-sponsor form we'll probably lose that chance since this form we'll need to be reviewed all over again, etc. It'd also be a 10 years GC so I guess we should expect them to scrutinize the interview and take their time to decide.
