Hi to everyone. I am really confused about this topic. I spoke with couple of immigration lawyers , and i was told if vawa I360 is denied and i am out of status i will get NTA and be in removal proceding( even if i dont have criminal record or prior deportation) .On the other side other lawyers ( not only one) told me this is considered humanitarian case and by new Biden memorandum from 2021 January they dont send NTA and they dont put you in removal if you are out of status. If you have criminal record deportation order or if they find fraud thets different of course. Some popular YT immigration lawyers also say by new policy they dont issue NTA for vawa denial. Its hard to know who to believe and this is important to know consequences if we are denied. Anyone who had experience?
To make clear i am talking about denial based on lack of evidences to prove bona fide marriage or lack of evidence that you suffered cruelty . Thanks !
