Travel Document, I-94 expired but Valid EAD Card in Hand

  • Travel Document, I-94 expired but Valid EAD Card in Hand

    Hi,

    I have a question about the travel document, I-94. I have my EAD, that expires in 2012 but my I-94 expired in April 2010 and Travel Document expired on October 19, 2010. Will I-94 and Travel Document expiration impact on the status in USA. Please let me know, Do I need to apply the Travel Document immediately for the staus.

    For my wife: She has Travel Document stamped till June 2011 on both the Travel Documents and she doesn't have the blank one. Can she travel again with the same Travel Documents any number of times until June 2011 or do we need to apply the new Travel Document.

    Please give any suggestions/advices asap.

    For your wife, if you are talking about the Advance Parole document--

    They send you two of them. It is my understanding from people who have used them to return to the US that the immigration officials normally take one and give the other back. Next trip the traveler takes a photocopy and the remaining original. The immigration officials keep the photocopy and give back the original so you can make a photocopy for another trip. I don't know why a photocopy to leave with the officials on the first trip wouldn't work just as well. You should take one and ask if they will accept the photocopy for their files instead of keeping one of the two originals. Then you could keep one in a safe place as a backup in case you lost your documents while traveling.

    I don't really understand your situation. I thought the I-94 showed your allowed time in the US and it is turned in when you leave, getting a new one each time you enter. And if it expired, you are "out of status." And I thought to get into the US you need a valid visa, visa waiver, Advance Parole, or green card. I don't think an EAD card alone will get you back in, but I could be totally wrong. So I guess I don't understand on what basis you will apply for Advance Parole, unless you have a pending I-485 Adjustment of Status and a receipt of filing. Maybe if you give a little more information, somebody can comment who knows for sure.

      Thanks Nichole. My I-485 Adjustment of Status is in pending and Advance Parole is based on my I-485.
