    What happens if someone registers birth late and gets the birth certificate?
    How does it affect AOS?

      I am also in same boat

      people say I will get RFE for more evidence. Who knows we have to just wait and see.

          ND is notice date of my I-485

            My wife and I are in the same boat. We got an RFE saying that the late birth certificate is not sufficient and asked for two sworn affidavits for the date of birth and oldest available documents that contain date of birth and name of both parents. We got the two affidavits and also submitted copies of the admission form, the original birth affidavit that had been filed with the school for admission, leaving certificates etc. Hopefully it will do the job.

              What are these oldest available documents. Can you may be give us an example ?

              Also please let us know how long you have been waiting after you submitted your additional evidence for approval ?

                I submitted a copy of the birth affidavit that was filed with the school when I was admitted to the school in class 1. I also submitted a copy of the admission form on record with the school, along with a certifacte from the principal saying that my DOB according to their records is such and such. It took some convincing of the school authorities to let us take copies. I also submitted copies of the SSC certificate, leaving certifcate, driver's license from India etc. Same for my wife.

                    I am also in same boat, expecting RFE. Can you please tell me what shold be the contents of affidavit. Anyone who has already done it, your input will be greatly appreciated. Thanks in advance

                      Are you sure you will get RFE?,
                      Is it that in all 100% cases, where in late registered birth, INS is asking for RFE? or only some cases?

                        I did not get this. LAte REgistered Birth means it was not registered at the time of Birth OR it was registered but got the certificate recently(late).

                          Birth Certificate

                          My attorney told me that all BCs obtained later in life do not get an RFE. Only those that have translation/name problems or any other problem. I am inclined to agree, reading the posts on this and other boards. Please verify that your BC, though obtained late, does not have any spelling or other errors and keep your fingers crossed. Everyone does not get RFE automatically, it is IIO/interpretation dependant. My BC has my name as in the passport & is in English, hoping for the best.
