information regarding court case decision copy attached with aos

hi , i m new here . i just wanna know we are just married before few months .we are ready to filing our aos 1-485 with in few days but my husband have one misdimenor ticket on his record (like bear sell to minor and one criminal summon from court regarding check after appearing in court this charge is dismiss on the first hearing ) so my question is this ,

1. can we need attach court decision copy with all documents or no ?

2. can we need attach disposition letter (may be i dont know exect word) issued by court ?

3. this things effect on aos also or no ?

4. in marriege case we need to attach police clearing report from usa or no ?

5. when my husband get ticket with misdimenor charge against selling bear to minor then police department take my husband fingerprint also so this thing also effected with aos or no ?




we need proper guidence and help ....we are confused regarding this bcoz everybody have diffrent advise regarding this .so plz help us .if any body have same experience .

It really depends on if he was working legally or not. If he was illegally working in a store, it could cause AOS issues.
You just need to mention the arrest/conviction on the 485 and save the court certified records for submission. You can attach the final court disposition with the 485 but will still be called for an interview at the local office where you have to present the documents again and explain what happened.
As this MISD does not involve CIMT, it can be claimed as a petty exception category. Check with your lawyer.

and did you read the whole form and also the instructions which are a separate download?


If you read the form I-485, you will find on page 3 a list of questions about crime. If the immigrant answers yes to any, they are to attach a separate page explaining.

If you look at the instructions for I-485, page 3 gives a list of initial evidence to send, starting with Criminal History. There is a half page telling what to send depending if charges were filed or arrested but no charges filed, etc.

So if husband is the immigrant he has some police and court documents to send.

hi , but i wanna just inform you when he get misd ticket from store that time he is not working there he is just standing in uncle store that time uncle is going in outside for parking car then custmor coming he give bear , and after that he go in police station ...police department take finger print and picture after that he go in court judge says pay fine then his uncle pay fine . this is the all story regarding ticket . and that time he is on visitor visa.


so guide us what effect about this ticket on aos 1-485 ?
