  • Please help I dont know what to do!!!!

    First of all thank you all for looking at my thread.
    Here is my story..... I came to USA first time at 2006 on J1 visa and got my social number which is authorized only while visa didnt expire, I went home on time and came back in 2007 and left again on time. Third time i came in 2008 june and my visa expired in november 2008 and at that time i was short on money to change my status so there i was out of status from november 2008 until now. I got job in restaurant in march 2009 and i used my real social number even if out of status i felt bad working under table so I wanted to pay tax which i did and did tax refund as well. I also met my wife at same restaurant where we still work together and she is USC and want me to get papers so we can travel to Europe for honeymoon ,i was reading online that if i worked on my social and out of status i will be denied and that my wife and me met in restaurant where we work is red flag for USCIS officer. Can anyone help please?????

    When you receive a social security number here it is for life. It does not change that number is yours for LIFE.
    As far as the overstay goes should not be a problem as you are married to USC. But you will have to have lots of proof of your relationship and marriage for AOS interview. As USCIS may see that because you overstayed you got married so as to stay in the country which is classed as immigration fraud. If you have lots of evidence and you can prove your marriage is a bonafide one then you should have no problems. Overstays are pretty much ok when you AOS unless you came on a VWP then it would be worse and that would be a ban, I would also suggest you get a good immigration lawyer, cause of your long overstay but you paid taxes and all but still here illegally.

      Thank u so much for reply I have a lot of evidence that my marriage is bonafide i love my wife a lot so that is not going to be a problem. Pics, joint account, bills payed together etc... I am only worried that i worked on my social while out of status, so you think i wont have any problems on interview cause of that?? Just one more thing my J1 was not subject to section 212(e), 2 yr rule doesn't apply

        Working is no issue as your unauthorized employment is forgiven since you married a USC. DO NOT leave the country till you get the actual Green Card in your hand or else you will be banned to return for 10 years. You don't need a lawyer, the case is simple and its a matter of filing the right forms.
        Some people here try to scare folks and ask them to hire lawyers. I find this VERY wrong. Either they are lawyers or work for law firms and try to get business from this site.
