Background:
I have a priority date of 18-May-2011 and received an AUDIT on PERM in Aug 2011. My six years H1 Cap completes on 19-Mar-2012. From what the attorney said that I could be eligible for year-to-year H1 extension only if I had my prority date before 19-Mar-2011 or if I140 gets approved.
Question:Could I be eligible to apply for "Adjustment of Status" when staying in the US or there is no other option but to move back to India and apply for H1 Consular Processing (i.e.I need to move back to India by 19-Mar-2012 and can come back again depending on the approved H1 extension not before 17-May-2012 (i.e. for 2 months)).
Any kind of help is much appreciated !!!
