I apologize if I am found not being able to use the correct wording. I know that will hurt the accuracy of my question, but I hope you are still able to share your opinion with me. Wife and I are married for 20 some years and we have been in this country for 15 years as Chinese born Canadian. My wife got her GC last year, while I am waiting for my I-485 to be decided upon since 10/2007. I was under my wife's I-485 application initially. Then my employer offered to sponsor me. I thought it was a good idea and switched wagon. My I-485 is in the lowest class, which I believe is EB3. My question is: which will it be faster for me to get my GC, to continue waiting for my I-485 to be approved or to swtich to the process that entitles me the GC by virtual of being a spouse of a GC holder? If latter, what is the process and processing time? Thank you.

It is in your best interest to stay where you are because you must have accumulated time ( seniority ) on your application and your application determination is based on those before you- ( i.e the longer you are in line the nearer you are to the front) however if you withdraw your application and refile with your wife you will be starting all over again and it may not move faster than what it is now but if and when your wife becomes a citizen and your case have not been decided you may now file as the spouse of a US Citizen and get your permanent card within 4-6months( cos your marriage will be older than 2 years anyway). As long as you are getting your work authorization and I-131( Parole document to travel out the country back and forth - though I advised against it until you have your card in hand)
