Filing COS from L-1B to H-1B and also filing EB1C

    Hi, Senior Members

    Please help me regarding my situation.

    I am on L-1B 5th year now with Company A and it is going to expire on Dec, 2012.

    Company B is going to file COS from L-1B to H-1B this year that is going to start from Oct 1, 2012.

    Company A and company's attorney suggested to file I-140 using EB1C. The I-140 filing may happen on last week of April, 2012 in Premium Processing. If, I-140 approves then I can file I-485 by June 1st week. (Note: I am not going to file I-140 and I-485 concurently)

    In this situation, Will my I-485 gets approved without any issues or will I get any issues with COS H-1B?

    If my I-485 approves before October 1, 2012 then I think there will be no problems. But, if my I-485 will not approve before October 1, 2012 then what will happen. Still can I join the new company or I need to stay with current company using EAD?

    Please suggest.
