    Hi Folks,

    Need help on this urgently. So if anybody can help me out that will be rgeat. The problem I am having is that I did my Consular processing last year and I got the stamp for the Green card. My card got lost in the mail so I applied for a duplicate. It hasn't arrived yet. I am trying to finance my House and the lender does not accept the stamp ( I-551 ) on the passport since it is valid only for 1 year. The question I have is that if you have done CP, is there any other document other than the stamp to prove that you are a permanent resident. If you do CP then you don't get the I-94. So I don't even have that. Please help.

    The stamp is your proof. If it is expired, you can get a new one at your local INS.
    The stamp is the only proof you have if you don't have the card yet.
    AN I-94 wouldn't prove it, in any case. The I-94 would only show that you were admitted in non-immigrant status until a certain date.

      If you applied for a duplicate then you have presumably filed an I-90. When you file an I-90 you should recieve an I-797 receipt notice indicating the the INS has recieved your I-9o Application.

      This (in combination with the stamp in your passport) should be enough to convince the lender that you are a permanent resident as the I-797 will have your A number on it as well as the petition type (I-90).

      Since only a Permanent resident can file an I-90 and get a receipt for it with an A Number on it it should be enough. If it @#%$'t then you need to contact an attorney as the lender may be engaging in unfair (and illegal) discrimination (under the Equal Housing Opportunity Act).

        Also you could give them the name of your immigration attorney who will be hapy to advise them about the procedures of the INS and what the I-797 means.

        Also point out that the I-797 means you went to the INS office "in person" (since I-90s must be filed that way) and they accepted your application after checking you out (which they would not do if you were not a Permanent Resident).

          lenders do not need to know your immigration status. just your credit history. non immigrants can get financed for cars, houses etc

            True, but they may consider you a higher risk if you are not a PR.

              Hi friends,

              i would like to know whether the H1B visa holders with valid
              I-94 are considered permanent residents or only GC holders?.

                I just got a home loan myself and was asked nothing about my immigration status. One of my friends got a loan couple of months ago and was asked for proof of H-1 B status etc

                so I guess it depends on the lender. even citizens run the risk of getting into legal trouble ( eg going to prison for a criminal offence) and not being able to make the payments. the lenders have to take some risk in return for charging you any interest.

                so i would just talk to the lender and tell him that you would take your business elsewhere if they ask too many stupid questions
