  • lapsed /lost green card and re-entry

    Hello,
I obtained a green card through a lottery in 1993, i subsequently spent 4 months in the US before returning to Europe to finish my studies.
I have not been back since and have filed no aditional tax files etc since 1994.

My husband will soon be issued with a L-1 visa and it is our intention to move to the US as a family for 2 to 3 years while he sets up a new branch of his bosses company.

From what i understand, i should automatically be eligible for a L-2 visa.

But - will i have problems regarding the old green card??
I have no idea where my old passport is, did not to my knowledge fill out a I407 (Abandonment of Lawful Permanent Residence) don't think i have any papers regarding my social security number - or anything really...... Long lost and forgotten by me - but not i'm sure to the immigration service!

I will evidently be compleatly honest about all this, but might there be a risk that my visa would not be issued and my husbands work plans as well as our family plans will be refused??

    Many thanks for any advice!

Given the definitive purpose for which you will be going to the US as a family, it is highly unlikely you will be refused a visa. If you still have the GC, take it with you and officially surrender it. If not, explain your situation. You never returned to the US after that 4 month trip?

      Thanks for reply!
No - never been back since as opportunity never came my way. Met a french man and went to live in France instead!
Will ask my mum if she has maybe put it away somewhere - the GC is certainly not in my possesion and i don't seem to have my old passport either.
Will tell the Visa agency my husbands company uses in any event!
      Thanks again

If you have ANY documentation, especially your A number, keep it. The A number will help them consolidate your immigration files. Otherwise, you MIGHT have two, and it might cause confusion in future, say, if you apply for permanent residence again, or even citizenship, as they'll have to consolidate your files and delay your processes.
