I'm a mother (Hungarian citizen, currently resides in the UK) of a child of 8 years old who is a double citizen and currently resides in the US. I divorced his father who is a US citizen in 2008. Back then we agreed I would raise my child in the EU and I did not maintain ties to the US other than I let my child travel to his father during his holidays, once or twice a year. My child spent one year with my permission with his father and now that he is 8 and experienced a longer period of time in California and with his father, he said he never could use to the long flights between us and he wants us to live closer. His father is willing to sponsor my relocation to California. I scanned through my options to re-obtain my green card but I don't seem to fit into any category. This summer I came to California to spend 3 months (my visa time as traveler) with my son here and discover my options and how I would feel like living here. I already signed a new parental agreement for shared physical custody it happened kinda under pressure to prevent a possible legal fight which may take years and would just make my child unhappy anyway. In the parental agreement my ex also accepts his full financial responsibility for my relocation (basically until I get into full employment and earn more than $2000 a months which sounds reasonable and acceptable for me). I am not sure where to start and what is the way to proceed towards my renewing or my brand new green card. Can an ex husband (no, I would not remarry him) sponsor a relocation in order our child to have both parents live in the same country? I am a bit confused and worried that I agreed to the shared physical custody without exploring my immigration options.
