  • Rentry after Green Card Approval

    I had to leave USA before I could receive my Green card. I don't even have the notice with me.

    I already have my Advance Parole, but I think I don't have to show that document at the Port of Entry.

    I'm thinking of asking my wife to scan the Green card and the notice we received and email it to me.
    I will be taking a print out of that.

    And also my wife will be waiting with the actual card at the airport.
    My question is: At the airport, will the immigration officers allow my wife to give the GC to me?

    Can you please let me know the procedure and all the documents I will be needing while entering USA.

    If using an Advance Parole to reenter the U.S., you will have to show the Advance Parole at the Port of Entry. It is possible that your Green Card approval might have caused the Advance Parole card to expire, but that remains to be seen.

    Your wife will have no way of handing your Green Card to you at the Port of Entry. Contact is not normally allowed while processing as an entrant. On the other hand, if you are detained for lack of a Green Card, that might provide an opportunity for your wife to discuss getting the Green Card to you.

      Thanks for the response. Can you please let me know the list of documents that I need to show at the port of entry.

      Do they accept photocopy of receipt notice and photocopy of the green card?

        If your advance parole is valid, you can still use that to enter the US. If your wife can FedEx your GC to you, that would work too. But really, you are in a situation for which AP exists.

          Thanks for your reply. I'm not comfortable fedexing my GC to India. I just hope that my AP will work.

            Regaining my Grren Card

            I lived in the US for 13 years after obtaining my green card. Then I left to go back to Europe. Now - 20 years later - I wish to get my green card back or get a new one. I have travelled back and forth to the US several times in the past 2 years - in fact I have been in the US more months than abroad because I have a ten year visa. My wife is American and can apply for my visa:
            2 Questions:
            Is it better to apply when I am in the US as a visitor, or should I leave and apply from abroad?
            Should I extend my stays of 6 months in order to apply?
            Am I in trouble because I stayed so long in the US? I never overstayed my visa (6 month) limit.

              If your wife re-petitions and adjusts your status while you are in the U.S., there is less uncertainty and waiting. Currently, immigrant petition approvals, if beneficiary is outside the U.S., are taking longer than normal...at least 8 months for petition approval alone before going to the National Visa Center for pre-consulate processing.

                Entering the US on your visitor visa with the intent of adjusting status is fraud. Keep that in mind. You can CLAIM that you changed your intentions AFTER you entered the US, and it's up to you how convincing you can make this. CIS might hassle you a bit, but in the end you're unlikely to be given too much grief.

                But, given your intention at this point, the right way to do this would be via consular processing OUTSIDE the US.
