HELP: Resubmiting I-131, do I have to be physically in the US to do it?

Hi,

I'm a LPR and while I’m expecting for my husband’s visa, I’m living overseas.
I went to US to submit the I-131 form (reentry permit)

I received an I-797C (Notice of action) saying that my petition was rejected because I used an old version of the file (?!?)

Does anyone knows if I have to be in US to resubmit it?

The normal requirement for applying for a Reentry Permit is that you must be in the U.S. when applying. Use the 3/22/2013 version of the form.

The Reentry Permit is usually issued for the maximum time you can be outside the U.S. before your Green Card status is jeopardized. If the Reentry Permit has expired when you reenter, and you have been out a full 2 years or more, you might be allowed in, but you can expect "adverse adjudication" requiring a hearing at Immigration Court.
