    Hi,

    Could someone, who has gone through the CP, please let me know the kind of "details" mentioned in oath at consulate, regarding joining the same employer after returning to US?

    I "accepted an offer" before I even got packet 3. And also "started" H1 transfer process, thinking of dropping GC processing with old employer. But I am still with the old employer.

    Can I still go for CP with old employer, "take oath" and then after coming back join my old employer and "after one month" join the new one?

    Is it a right thing to do?
    Assumption is, old employer is friendly.
    Please reply. I would appreciate it.

    The letter you have to sign at the consulate says something like - you understand that you are getting this employment based visa because your employer sponsored you and when you go back to US with this immigrant visa, you are supposed to report to your employer who sponsored you.

    That's all it says. It does not say anything about the length of employment with sponsoring employer or any other details.

      What if it is a self-petition ? (signing CP doc)

      I am wondering what happens if the green card
      case is an employment based self-petition.

      Do I still have to sign this document ?
      It does not make sence for a self-petition .

      Please let me know your thoughts.

        Hate to be the one to reply to my own post,
        but I found this in another thread.

        All it says is that you need to have the same
        employer till you enter the US. So, one could
        enter the US, work for the employer for one day
        (if that) and then change jobs.

        I had read this paper very carefully. It said 1) if there is a change in status of employment before you entered the US.... or 2) not joining employer after...

        It did NOT put any clauses on length of stay with current employer

            "Oath Document" for "CPers" at New Delhi


            Quick take -- there is NO document with Oath etc. that was presented to me.

            The whole face-time at the window was "under three minutes" -- wish I had a stop watch to have clocked it.

            But, No I-864s were taken, No I-134s or whatever were taken. Only the Employer's letter was most important for my case, and my B/Cert. + Marriage Cert. X-Ray Slides at Delhi Medicals were not taken by JFK INS. Duh?

            Released from Bondage = Jan 16th. 2001
            Port of Entry JFK = Jan 29th. 2001

            Awaiting plastic card and looking out of the well into the job market, but Hey! While I have been in this "well" they say the Economy has begun cooling off!! Damn! Just when we thought of checking out the green pastures!! But then, All's Well that End's Well. We know there's a massacare out there today!!

              No signature for me either

              So, I am assuming that Bombay consulate has
              done away with this signature business.
